Terms of Service

Solution Focused Financial LLC policy information for EMaiL BOSS users.

These Terms of Service ("Terms") govern your access to and use of the EMaiLBOSS program, related software, APIs, and emailboss.ai website (collectively, the "Services") provided by Solution Focused Financial LLC, doing business as EMaiL BOSS ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.



1. Eligibility

  • To use the Services, you must be at least 18 years old or the age of majority in your jurisdiction. By using the Services, you represent and warrant that you meet this requirement.
  • You must have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.


2. Account Registration & Security

  • EMaiLBOSS may require you to authenticate with third-party accounts (such as Google or Microsoft) to enable features. You are responsible for maintaining accurate information associated with those accounts and for complying with the third party's terms.
  • You are responsible for safeguarding your account credentials (username, password, and any two-factor authentication). You agree not to share your account login details with anyone.
  • Notify us immediately of any unauthorized use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to keep your credentials secure.


3. User Data & Privacy

Our collection, use, and sharing of your personal information is governed by our Privacy Policy. By using the Services, you consent to our practices described therein. We utilize Google APIs and Microsoft APIs to provide core Gmail, Outlook, email, and calendar functionality. Our use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Microsoft account data is used only to provide the user-facing features you request, as described in our Privacy Policy.



4. Permitted Uses & Restrictions

  • Permitted Uses: You may use the Services to integrate EMaiLBOSS with your email account(s), leverage AI-driven categorization, automated replies, attachment summarization, and any other functionality made available by the platform.
  • Restrictions: You agree not to:
    • Reverse engineer, decompile, or disassemble any part of the Services;
    • Use the Services to violate any applicable law or regulation;
    • Upload malicious code, viruses, or any content that interferes with or disrupts the integrity or performance of the Services;
    • Scrape, copy, or collect information from the Services for unauthorized purposes;
    • Attempt to gain unauthorized access to any part of the Services, other user accounts, or computer systems connected to the Services;
    • Use the Services to send unsolicited or spam emails or communications;
    • Impersonate another person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.


5. Intellectual Property

  • All content provided through the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Solution Focused Financial LLC, doing business as EMaiL BOSS, or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
  • "EMaiLBOSS" and the EMaiLBOSS logo are trademarks of Solution Focused Financial LLC. You are not permitted to use these marks without our prior written consent.
  • Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your internal business purposes.


6. User Content

  • "User Content" means any content you submit, upload, post, or display through the Services, including but not limited to email text, attachments, and any associated metadata.
  • By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to access, process, and display such content solely as necessary to provide the Services you request (for example, generating drafts, summaries, categorization, and automation results). We do not sell User Content or use it for advertising. To the extent User Content is transmitted to third-party service providers (e.g., OpenAI) to perform a user-requested function, it is transmitted only for that purpose and subject to the provider's terms.
  • You represent and warrant that you own or have all necessary rights, licenses, and permissions to grant the foregoing license and that your User Content does not infringe any third-party rights.


7. Subscription & Payment

  • Certain features of the Services may require a paid subscription. If you elect to purchase a subscription, you agree to pay the applicable fees as described on our pricing page.
  • All fees are non-refundable, except as required by law or as expressly provided in these Terms.
  • We reserve the right to change our subscription fees or introduce new fees at any time. We will provide at least 30 days' notice before any material price changes.
  • Failure to pay any fees when due may result in suspension or termination of your account and access to the paid features.


8. Termination

  • We may suspend or terminate your account, or your access to the Services, immediately upon notice if you breach these Terms or if we believe you have engaged in fraudulent or illegal activity.
  • You may terminate your account at any time by following the account cancellation procedures in your account settings. Upon termination, your right to use the Services ceases immediately.
  • Upon termination, any unpaid fees or charges remain due and payable. We may delete or deactivate your account and all related information at our discretion.


9. Disclaimers

  • The Services are provided "AS IS" and "AS AVAILABLE" without warranty of any kind. We disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, secure, or completely accurate. You use the Services at your own risk.


10. AI Services & Accuracy Disclaimer

The Services utilize Artificial Intelligence (AI) technologies, including large language models (LLMs) provided by third parties (e.g., OpenAI). You acknowledge that:

  • AI-generated content (summaries, drafts, business suggestions) may contain errors, hallucinations, or inaccuracies. It should not be relied upon as a substitute for professional legal, medical, or financial advice.
  • You are solely responsible for reviewing and verifying all AI-generated output before taking action or sending communications based on such output.
  • We accept no liability for any loss or damage arising from your reliance on AI-generated content.


11. Third-Party Services

The Services integrate with third-party applications and APIs, including but not limited to Google (Gmail/Calendar), Microsoft (Outlook/Calendar via Microsoft APIs), and OpenAI. Your use of these features is subject to the respective Terms of Service and Privacy Policies of these third parties. We are not responsible for any downtime, data loss, or service interruption caused by these third-party providers.



12. Limitation of Liability

To the maximum extent permitted by law, in no event shall Solution Focused Financial LLC, doing business as EMaiL BOSS, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with these Terms or the use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.

In no event shall our aggregate liability for all claims related to the Services exceed the amount you have paid to us in the 12 months preceding the claim, or one hundred U.S. dollars (US$100), whichever is lower.



13. Indemnification

You agree to indemnify, defend, and hold harmless Solution Focused Financial LLC, doing business as EMaiL BOSS, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Services, your User Content, or your violation of these Terms.



14. Governing Law, Arbitration & Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, the Services, the website, software, subscriptions, payments, account access, data handling, communications, or any relationship between you and Solution Focused Financial LLC, doing business as EMaiL BOSS, will be governed by the laws of the State of Florida, without regard to conflict of laws principles, and by the Federal Arbitration Act to the extent applicable.

Before starting arbitration, the party raising a dispute must first send written notice describing the claim and requested relief. The parties will attempt in good faith to resolve the dispute informally for at least 30 days after notice is received.

Except for matters that may be brought in small claims court, requests for temporary or preliminary injunctive relief, or claims involving intellectual property misuse, any dispute that cannot be resolved informally will be resolved by final and binding arbitration on an individual basis. Arbitration will be administered by the American Arbitration Association under its applicable rules, unless the parties agree to another arbitration provider. The arbitration may be conducted remotely unless the arbitrator requires otherwise.

You and Solution Focused Financial LLC waive the right to a jury trial and agree that disputes will be brought only in an individual capacity and not as a plaintiff, class member, or representative in any class, consolidated, collective, or representative proceeding. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim.

If a court or arbitrator determines that any part of this arbitration provision is invalid or unenforceable, the remaining parts will remain in effect to the maximum extent permitted by law. For any dispute that is not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state or federal courts located in Tampa, Florida.



15. Modifications to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by posting a revised version on the website and updating the "Effective Date" at the top. Your continued use of the Services after such changes constitute your acceptance of the new Terms.



16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.



17. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Solution Focused Financial LLC, doing business as EMaiL BOSS, regarding the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
